Terms of Service

Welcome to Gemspot — a free community treasure hunt where you find QR stickers at local businesses, solve riddles, and climb a leaderboard. These Terms are the agreement between you and Gemspot, Inc. for using the Gemspot app and www.gemspot.app (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

Play safely & at your own risk

Gemspot sends you to real places in the real world. You are responsible for your own safety and for the safety of anyone with you. Always obey traffic laws, pay attention to your surroundings, and never use the app while driving.

Only enter places you're allowed to be. Don't trespass, don't ignore a business's rules or hours, and respect private property. Gemspot is not responsible for any injury, loss, or damage that happens while you play. You take part at your own risk.

Who can use Gemspot

You must be at least 13 years old to create an account. If you're under the age of 18, you may use Gemspot only with the involvement and permission of a parent or guardian, who agrees to these Terms on your behalf. By using the Service, you confirm you meet these requirements.

Your account

You're responsible for the information you give us and for keeping your login secure. Provide accurate details, keep them current, and don't share your account or let someone else use it. You're responsible for activity that happens under your account. Tell us right away if you think your account has been compromised.

The game, and how rewards work

Gemspot is free to play and is a community activity for fun and local discovery. Badges, streaks, found-gem counts, and leaderboard rankings are forms of recognition only. They have no cash or monetary value, cannot be redeemed, sold, or transferred, and are not prizes.

Gemspot is not a contest, sweepstakes, lottery, or game of chance, and no purchase is ever necessary to play. We may add, change, move, or retire gems, riddles, and game features at any time.

Playing fair

To keep Gemspot fun for everyone, you agree not to:

Remove, cover, deface, move, or tamper with the QR stickers, or place stickers of your own.
Falsify your location, use bots or automated tools, or otherwise cheat to gain leaderboard standing.
Create multiple accounts to manipulate rankings.
Harass, threaten, or harm other players, businesses, or staff.
Damage, disrupt, or attempt to gain unauthorized access to the Service or its systems.
Use the Service for any unlawful purpose.

Leaderboards and what you share

Gemspot has public leaderboards. The player name and home town you choose may be shown to other players alongside your rankings and times. Choose a player name that is not offensive and that you're comfortable showing publicly. We may remove names or content that we consider inappropriate, and we may reset or correct rankings affected by cheating or technical errors.

Local businesses and sponsors

Gems are located at independent local businesses, and Gemspot may feature local sponsors. These businesses are not operated by Gemspot. Their hours, access, products, and services are their own, and a gem's presence at a location is not a promise that the business is open or available, nor an endorsement by either party. Any dealings you have with a business are between you and that business.

Intellectual property

Gemspot, including the app, website, name, logo, riddles, graphics, and content, is owned by Gemspot, Inc. and protected by law. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial enjoyment. You may not copy, sell, modify, reverse engineer, or create derivative works from the Service without our written permission.

App store terms

You downloaded Gemspot from a third-party app store, such as the Apple App Store or Google Play, and you also agree to that store's terms. You acknowledge that this agreement is between you and Gemspot, Inc. — not Apple or Google — and that the app store is not responsible for the app, its content, or support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. You confirm you are not located in a country subject to a U.S. embargo and are not on any U.S. government restricted-party list.

Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We don't guarantee the Service will be uninterrupted, error-free, accurate, or secure, or that gems, riddles, and locations will always be available or correct.

Limitation of liability

To the fullest extent allowed by law, Gemspot, Inc. and its owners and team will not be liable for any indirect, incidental, special, or consequential damages, or for any injury, loss, or damage arising from your use of the Service or your participation in the game. Our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars ($100). Some jurisdictions don't allow certain limitations, so parts of this may not apply to you.

Indemnification

You agree to indemnify and hold harmless Gemspot, Inc. from claims, losses, and expenses arising out of your use of the Service, your violation of these Terms, or your violation of any law or the rights of others.

Suspension and termination

You can stop using Gemspot and delete your account at any time. We may suspend or terminate your access if you violate these Terms or misuse the Service. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will continue to apply.

Changes to these Terms

We may update these Terms as Gemspot grows. When we do, we'll update the "Last updated" date above and post the new version here. If you keep using the Service after changes take effect, you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict-of-laws rules. You agree that any dispute relating to the Service will be handled in the state or federal courts located in Oklahoma, unless applicable law requires otherwise.
